CONTEST (hereinafter referred to as ‘Contest’) is conducted by
Perfetti Van Melle India Private Limited (hereinafter referred to as ‘PVM India’) having its registered office 47th Milestone Delhi – Jaipur Highway, Manesar 122050, Gurgaon (Haryana) and corporate office at 1st Floor, Tower A, Global Business Park, MG Road, Gurgaon – 122002 (Haryana) through its agency Glitch Advertising Pvt. Ltd. (hereinafter referred to as ‘Agency’), being the digital agency having its office at Plot No. 131, Sector 44, Gurgaon, Haryana. Before participating in the Contest, please read the terms and conditions given herein.
1. Contest Period: The Contest shall be commencing on 30th December, 2016 at 12.00 P.M. hours (for Facebook and Twitter) and concluding at 4 P.M. on 30th December 2016, (hereinafter referred to as ‘Term’).
2. Any entry for the Contest before 30th December 2016 (12.00 A.M hours and after 4.00P.M. on 30th December 2016 (for Facebook and Twitter) shall not be entertained and summarily rejected.
3. Eligibility: (i) Participant(s) must be a citizen of India; residing in India. Residents of other countries and non-Indian citizens are not eligible to participate. (ii) The Employees, agents, associates and promoters of PVM India and of its affiliates, subsidiaries and advertisement agencies (including their immediate family members) and all others directly associated with organising the Contest(s) are not eligible to participate. (iii) Participants should be registered user of Facebook and Twitter and follow Center Fresh India (@CenterFreshIndia) on Facebook and Twitter to submit their tweet or upload their photo. (iv) Participants should mandatorily use the hashtag “#FreshKickstart" & tag “@CenterFreshIndia” with his/her tweet or uploaded video. Without the above-mentioned hashtag & Tagging of official CenterFresh India twitter handle the entry will be disqualified.
4. No purchase of either Center Fresh or any other product sold by PVM India is required to participate in the Contest. No charges are payable to PVM India or the organisers to participate in or win the Contest. The Contest is not being conducted with a view to earn profit or promote the business or sales of PVM India and is intended to invoke interest in product advertisement.
5. To participate in the Contest, the participant (the “Participant (s)”) must submit the answer to the post shown on the /CenterFreshIndia page (hereinafter referred to as “Facebook ‘’) or www.twitter/CenterFreshIndia page (hereinafter referred to as ‘Twitter’) in the manner as given below: Through Twitter and Facebook, for easy reference of the Participants, steps on how to make an entry through Twitter and Facebook is enclosed as Annexure I.
6. There will be 8 No. (4 for Facebook and 4 for Twitter) of winners during the Term of the Contest. The prizes* will be as under:
i. 1 Flipkart Rs 1000 voucher for each winner.
ii. For redemption process & Terms and conditions binding the redemption of the coupons please refer to the website “www.Flipkart.com”.
iii. The final gifts will be delivered by PVMI or its agency within one month from the day of announcement of the results
* PVM India reserves right to change the Prizes/value of the Prizes, without providing any prior notice to the Participants.
7. The name of the Winners will be declared on or before 31st December 2016, 8 p. m.
8. A) The criteria for selection of winners will be as follows:
i. Step 1: The Participants are required to tweet/ post their answers in response to the question asked during the Term. The below elements can be used in the tweet/ posts being sent as a response: videos, gifs, photos, doodles or text only within one tweet/ post.
ii. Step2: Participants are to use the hashtag #FreshKickstart on their tweet/post and also tag the Center Fresh India official Facebook/twitter handle “@CenterFreshIndia” and Facebook handle “@CenterFreshIndia”
iii. Step 3: Tweets and Facebook posts submitted by the Participants shall be judged qualitatively by PVM and/ or the Agency.
iv. Step 4: Out of the response Tweets / videos / gifs / photos / doodles submitted, Top 4 responses on Twitter & Top 4 responses on Facebook will be selected by PVM INDIA and/or the Agent as winners during the Term and will be announced via the procedure provided below.
Prize Selection:
The top responses will receive a message from authorized representatives of PVM INDIA and/or Agent asking them to provide their contact details. Any delay in providing the requisite details, for more than 24 hours from the time of posting of the tweet or uploaded video, shall provide discretionary authority to PVM INDIA and/ Or Agent to contact a new winner.
Note: Participant(s) recognised as a winner(s) once, shall not be eligible for any of the subsequent prizes during the Term of the entire Contest.
B) A Participant can submit as many entries as he/she wants.
C) Entries may be submitted only according to the procedure described in these terms and conditions. Entry submitted through any other mode/platform shall not be eligible for the prize/s mentioned herein. The decision of agency/PVM India shall be final, binding and non-contestable.
9. The tentative dates and timings for declaration of prize winner(s) are as per below schedule:
On or before 31st December 2016, 8 p. m. on Twitter/Facebook.
10. The Prize Winner/Winners for Contest will be notified by PVM India or its Agency on the Center Fresh India Twitter handle along with a direct message (DM) being sent by @CenterFreshIndia to all winners on Facebook/Twitter. The Winners need to respond to the DM from @CenterFreshIndia and share their details asked in the DM (Ref Point 11). PVM India and its agents or representatives will use their best efforts to contact the prize winner(s). The name of the prize winner(s) will be announced on the Facebook / Twitter Page. PVM India/Agency shall not responsible in any manner whatsoever in regard to Contest and/or for non-receipt of any communication due to network failure, network congestion, network unavailability or any other technical issue or event/incidence not within the control of PVM India/Agency.
In case the prize winner for a Contest cannot be contacted even after 24 hours of attempted mail intimation, the selected prize winner will stand disqualified and the next eligible prize winner for the Contest will be selected by the Agency/PVM INDIA as per the selection criteria. If the original Prize Winner for a Contest is disqualified for this or for any other reason, such as being found ineligible or indulging in fraudulent practices or failing to comply with all these terms and conditions, then the next eligible Participant, chosen by PVM/ Agency will be declared winner and will be entitled to the prize instead, according to the aforementioned selection procedures.
11. The prize(s) will be awarded to the prize winner(s) after due verification and in accordance with the terms and conditions stated herein. The prize winner(s) shall, prior to collection of the prize, be required to submit to PVM India or Agency, valid ID proof, residence proof, PAN and/or any other document as specified by PVM India/Agency. The participant agrees to submit an affidavit in the prescribed format as to satisfying all the terms and conditions, tender evidence, if so required by PVM India. For valid ID proof as well as residence proof, any two of the following may be submitted:
a) Passport, b) Voter ID c) Driving License d) UID/Aadhar Card e) Nationalised bank passbook. PVM India reserves its right to waive/relax any of the above documentation requirements as it may deem fit.
12. The cost and expenses incurred towards conducting and administering the Contest are being borne by PVM India out of its own funds and same are not being recouped in any way from the Participants. However, the prize winner for each Contest shall be liable for income tax, levies and duties due and owing under applicable and statutory laws in connection with the prize(s). All other costs, expenses including travel expenses, cost of delivering etc., insurance, transfer fees, registration fees that may be applicable to avail/use/the prize(s) will be borne by the winner.
13. The prize(s) are non- transferable and non-negotiable. The Participants understand that the prizes are on "as is" without warranty of any kind, either express or implied, including but not limited to, merchantability, durability, suitability for any particular purpose, performances and/or non-infringement of any applicable laws.
14. The use of internet may be chargeable at the regular tariff rates. Consult beforehand with your service provider to know these charges. If entries are received for participation, it is assumed that the person sending in the entry has provided us with the permission to send SMS to or call him/her, whether or not such sender is registered on the National Do Not Call Registry.
15. Comment(s) chosen as winning Comment(s) shall be decided by PVM India/its Agency which shall be binding and non-contestable.
16. All entries sent by the Participant(s) would be received, monitored, verified, authenticated and stored by the Agency in their computer systems.
17. Entries submitted by the Participants which do not comply with these terms and conditions will be rejected. PVM India reserves the right at its sole discretion to disqualify any such entry at any time.
18. Mere participation in the Contest or submitting the comment(s) does not entitle the participant to the prize(s) unless all other terms and conditions are fully met. Failure to comply with any of the terms and conditions hereof or any fraudulent conduct shall disentitle the participant.
19. By entering into the Contest and accepting the prize, the Participants and prize winner(s) waive all the copyrights, rights of publicity and any related rights and specifically consents to PVM India’s right to audiography, videography, picture, tape or portray him/her as a participant/ prize winner and to exhibit this material in any and all media now existing or hereinafter created, including (without limitation) television, film, radio and print media without any compensation whatsoever for such advertising and publicity for perpetuity, except where prohibited by law. The Participants and/or prize winner(s) also consents to PVM India’s unconditional right to use his/her name, voice or picture or the contents of his/her Contest entry/ post for perpetuity.
20. By participating in the Contest, each participant agrees to hold harmless PVM India and its affiliates, directors, officers, employees and agents, as well as all others associated with the development and execution of this Contest, from and against any and all liability with respect to or in any way arising from this Contest, the awarding and use, misuse or possession of the prize, including liability for personal injury, except where prohibited or limited by law.
21. PVM India reserves the right to change the terms and conditions of this Contest and to alter or terminate the Contest at any time without prior notice. An updated version of the terms and conditions will be available on the Center Fresh Facebook/ Twitter page.
22. PVM India/Agency shall not be liable for any failure to comply with its obligations mentioned herein, caused by weather conditions, fire, flood, hurricane, strike, war, riots, political unrest, civil commotion, terrorist attacks, or any other event amounting to Force Majeure and beyond their control.
23. The Contest is not available (void) where prohibited by any law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of the Courts in Gurgaon (Haryana) only.
24. By participating in the Contest, each participant specifically accepts as follows (a) that he/she has fully read and understood all the terms and conditions including but not limited to the Annexure I below, and be unconditionally bound by them b) that he/she satisfies the eligibility requirements under these rules c) that he/she unconditionally accepts the winner so selected d) that he/she shall honour all decisions of PVM India with regard to the Contest and its interpretation and not challenge them (e) to comply with all Central, State, Local Laws and Regulations.
Annexure I
(“Steps on how to make an entry for the Contest through Facebook and Twitter”)
A. The journey of Facebook user to participate in Contest on Facebook:
i. For user who is an existing fan of Center fresh India Facebook Page:
Step1: User sees the Contest post on their timeline.
Step 2: User responds with a suitable answer to the question posed by posting in the comments section of the contest post on Facebook
Step 3: Responses are judged based on the quality of their response
Step 4: Winners are announced via a comment on the contest post on or before 31st December 2016, 8 p. m.
Step 5: Winners are to send contact details (including email address, full name and mobile number) within 24 hours of the announcement of the winner
ii. For user who is not a fan of Center fresh India Facebook page:
Step 1: User see's the contest post on their timelines via a share or any other mechanism and follows it to the Center fresh India page who then shall like and follow the page.
Step 2: User responds with a suitable answer to the question posed by posting in the comments section of the contest post on Facebook
Step 3: Responses are judged based on the quality of their response
Step 4: Winners are announced via a comment on the contest post on or before 31st December 2016, 8 p. m.
Step 5: Winners are to send contact details (including email address, full name and mobile number) within 24 hours of the announcement of the winner
B. The journey of Twitter user to participate in Contest on Twitter: For user who is an existing follower of Center Fresh India on Twitter:
Step1: User sees the Contest post on their feed
Step 2: User responds with a suitable answer to the question posed by tweeting to Center fresh India on Twitter
Step 3: Responses are judged based on the quality of their response
Step 4: Winners are announced via tweet on or before 31st December 2016, 8 p. m.
Step 5: Winners are to send contact details (including email address, full name and mobile number) within 24 hours of the announcement of the winner
For user who is not an existing follower of Center Fresh India on Twitter:
Step 1: User see's the contest post via a Retweet and follows it to the Center Fresh India twitter page
Step 2: User follows the Center Fresh India Twitter page
Step 3: User responds with a suitable answer to the question posed by tweeting to the Center Fresh India Twitter
Step 4: Responses are judged based on the quality of their response
Step 5: Winners are announced via a tweet on or before 31st December 2016, 8 p. m.
